The father and step-mother of 5-year-old murder victim Harmony Montgomery are under indictment on more charges, he as an armed career criminal and she for allegedly lying before a Grand Jury.
The state is questioning whether Kayla Montgomery is abiding by bail conditions that order her not to use drugs and also participate in a drug treatment program after police had contact with her in three incidents in August where drugs were seized.
According to State Attorney General John M. Formella, investigators have concluded that the Manchester girl, missing for nearly three years, is dead and that her death is the result of foul play.

The property is a focus of the investigation as it is a location where Adam and Kayla Montgomery previously lived, authorities announced.
Kayla Montgomery did not appear in court because the hearing was cancelled after she waived arraignment and extradition, and the defense and prosecution came to a bail agreement.
“The key finding of the investigation into Massachusetts’ actions in the case – that Harmony’s unique needs and wellbeing were not prioritized on the same level as her parents’ rights is one that New Hampshire should consider carefully,” said NH Child Advocate, Cassandra Sanchez.

On Thursday Senior Assistant Attorney General Jesse O’Neill said the investigation is “extremely active” and that police are talking to dozens of people. “We do feel we are making progress.”
